General Terms and Conditions for NexDay services.

1. Service Provider & Scope
- Provider: Tatah Agentur GmbH, Kolonnenstr. 8, 10827 Berlin, Germany
- These terms apply to all NexDay services including mobile app and web platform
- Registration: HRB 269191 B, Amtsgericht Charlottenburg
- Development: EE-DevOps division
2. Services & Subscription Plans
- Free Plan: 7-day trial with basic features
- Pro Plan: €4.99/month with advanced productivity features
- Advanced Plan: €9.99/month with AI features and family collaboration
- All plans include secure data sync and multilingual support
3. Contract Formation & Duration
- Contracts are formed when you accept these terms during registration
- Subscriptions renew automatically monthly unless cancelled
- Free trial converts to paid plan unless cancelled before trial end
- You can cancel your subscription at any time in account settings
4. Payment & Billing
- Prices include applicable VAT
- Payment processed securely through our payment partners
- Billing occurs monthly on your subscription date
- Failed payments may result in service suspension after notice
5. Right of Withdrawal (14 days)
- You have 14 days to withdraw from paid subscriptions without reason
- Withdrawal period starts from contract conclusion
- Use our withdrawal form at /widerruf/ or email support@nexday.app
- Early use of services may affect withdrawal rights
6. Data Protection & Privacy
- Data processing according to our Privacy Policy at /privacy/
- GDPR compliant data handling and user rights
- Secure EU-based hosting and encryption
- You control your data and can export or delete it anytime
7. Liability & Warranty
- We provide services with reasonable care and skill
- Liability limited to the extent permitted by German law
- No liability for indirect damages except in cases of gross negligence
- Service availability target: 99.5% uptime (excluding maintenance)
8. Termination
- You can terminate subscriptions anytime via account settings
- We may terminate for material breach with 14 days notice
- Data export available for 30 days after termination
- Refunds handled according to withdrawal and consumer protection laws
9. Applicable Law & Jurisdiction
- German law applies to these terms and our services
- Jurisdiction: Berlin courts for business customers
- EU Online Dispute Resolution platform available for consumers
